What are the Circuits Saying about FCA Pleading Standards?

The Supreme Court has declined to resolve the circuit courts' inconsistent rulings on whistleblower pleading obligations, most recently denying cert in three different cases that asked essentially the same question: what it means to “state with particularity the circumstances constituting fraud” under Federal Rule of Civil Procedure 9(b).
