SCOTUS Asks DOJ for Opinion on Relator’s Petition in SuperValu

The Supreme Court has asked the Solicitor General's opinion on whether the court should review the Seventh Circuit's decision in SuperValu Inc. In that holding, the circuit applied the Supreme Court's Safeco standard in concluding that the supermarket chain had an objectively reasonable interpretation of Medicare's usual and customary pricing rules for generic drugs.
