Fenwick – Since the start of the Biden administration, there has been an increased focus on combatting climate change, including regulatory actions to increase disclosure by corporations regarding their carbon footprint. In March 2022, the Securities and Exchange Commission, proposed regulations that would mandate certain climate-related disclosures in public companies' SEC filings. On November 14, the Biden administration proposed to amend the Federal Acquisition Regulation to require businesses with significant federal contracts to disclose climate-related data and to set targets to reduce greenhouse gas (GHG) emissions.
