Past Performance and Discussion Errors Did Not Prejudice Protesters; GAO B-413967, HP Enterprise Services LLC; Aon National Flood Services

Protests challenging various aspects of the evaluation of protesters’ and awardee’s technical and past performance proposals are denied, where the protesters’ challenges to the technical evaluation generally amounted to disagreement with the agency’s judgment, and where the protester was not prejudiced by a possible error in the past performance evaluation, because the awardee’s superior technical proposal was considered significantly more important than past performance; and protests challenging the agency’s discussions are denied, where the agency was not required to repeatedly raise the same issues the protester failed to address after the first round of discussions, and where the protester was not competitively prejudiced by a factual error in the agency’s discussions, because the agency did not negatively assess the changes made by the protester to its proposal as a result of the error; and protests challenging the agency’s price reasonableness evaluation are denied, where the agency conducted its price analysis based on adequate price competition and comparison to an IGCE; and protest that the agency failed to consider the awardee’s alleged organizational conflict of interest is denied, where the protester’s allegations were purely speculative and the agency’s conclusion that no OCI existed was reasonable.
