OFCCP Issues New Guidance on “Certainty” Principle

The Office of Federal Contract Compliance Programs has announced a new directive to provide clear and specific guidelines to contractors about what OFCCP expects of them so they can comply with the law. Under this new directive, OFCCP is establishing a process to facilitate the continued provision of clarity and certainty in OFCCP policies and practices.

In 2018, OFCCP adopted the four principles of Certainty, Efficiency, Recognition, and Transparency (the “CERT” principles) to improve compliance assistance and customer experience. With the issuance of the Certainty Directive, OFCCP has published directives in all four areas of the agency’s CERT principles. See the directives:
