Ninth Circuit Dismisses Whistleblower Claim Based on Public Information

The patent attorney relator in a qui tam suit alleging that Allergan has been using intellectual property laws to stop competition from generics, has failed to convince any of the judges on the Ninth Circuit that his suit is based on original inside information, rather than publicly available information.
