Next Step in SBA’s Implementation of Ultima Ruling to 8(a) Program

Bass Berry & Sims – The Ultima ruling threw the 8(a) program into tumult. Following the ruling, SBA issued interim guidance requiring participants whose eligibility is based on the presumption of social disadvantage to submit a narrative to maintain eligibility. SBA has since released additional guidance on the process for submitting social disadvantage narratives.
