Government is Bound by Software Licensing Agreement It Did Not Negotiate and Allegedly Did Not Even See; ASBCA No. 59519, Appeals of CiyaSoft Corporation

Appeal of a claim alleging that the government breached a software licensing agreement is sustained in part where (1) the claimant’s licensing agreement, which was included with the software packaging, was part of a contract with government even though the government did not negotiate and claimed to have not seen the agreement; and (2) the government violated the agreement by installing a single copy of the software on more than one computer and by failing to provide the claimant with a list of registered users.
