Fraud Jurisdiction at the ASBCA: Complicated and Complex

The Armed Services Board of Contract Appeals’ jurisdiction does not extend to the consideration of fraud, so cases where the government’s pursuit of a fraud claim conflicts with a contractor’s claim against the government are often stayed or dismissed without prejudice pending the outcome of a criminal case.
