FCPA Reform Bill Targets Companies with “Suspicious Behavior” in China

Senator Marco Rubio (R-FL) has introduced the Countering Corporate Corruption in China Act of 2022, the purpose of which he says is “to modernize the Foreign Corrupt Practices Act by clarifying that the definition of corrupt intent includes actions that excuse the genocide in Xinjiang, advance the Chinese Communist Party’s (CCP) propaganda efforts, or ‘invest’ in core CCP activities, among other actions.” He suggests that companies such as Amazon, Apple, Microsoft, Tesla, and Intel have probably “carried water” for the Chinese government at some point, and he says his bill would require such companies to “demonstrate that their actions are related to their underlying business, not part of a corrupt bargain” with the government or the party.
