DoD Has Issued a Class Deviation on Undefinitized Contract Actions During the National Emergency for the Coronavirus Disease 2019

Effectively immediately for undefinitized contract actions:

  1. The requirement in DFARS 217.7404-4(a) to limit obligations to 75 percent of the not to exceed price before definitization does not apply to undefinitized contracts related to the national emergency for COVID-19.
  2. The head of the contracting activity may waive the limitations of DFARS 217.7404(a)(1)(i), 217.7404-3(a), and 217.7404-4(a) if they determine that waiver is necessary for the COVID-19 emergency.
