Continuing Debate Over Government’s Prerogative to Dismiss Qui Tam FCA Suits

In another development in the judicial definition of the DOJ’s prerogative to dismiss qui tam complaints, the Eastern District of Pennsylvania has granted DOJ’s motion to dismiss a qui tam complaint brought by two relators, one of which was a shell company formed for the purposes of bringing the suit.
