Biden Signs Secure Equipment Act, Requires FCC to Ban Covered Chinese Communications Equipment from Obtaining Equipment Authorizations
While the FCC has taken several steps to reduce the presence of Huawei and ZTE equipment in U.S. communications networks, the FCC rules do not prohibit the agency from reviewing and authorizing RF devices manufactured by these companies. To address this perceived loophole, on November 11, 2021, President Biden signed into law the bipartisan Secure Equipment Act of 2021, which requires the FCC to adopt rules clarifying that it will no longer review or approve any application for authorization of equipment that is on the agency’s “Covered List.” The Secure Equipment Act requires the FCC to adopt the rules no later than November 11, 2022.
