ASBCA Will Hear Disputes Regarding Contracts Implied-in-Fact

In a recent decision, the Armed Services Board of Contract Appeals held that contractors have the right to bring an appeal even if the government claims a contract does not exist: a Contracting Officer’s Final Decision responding to such a contract is not not necessarily required.
