A prior decision by the Small Business Administration Office of Hearings and Appeals finding the awardee is not an eligible small business because it is affiliated with its joint venture partner is affirmed, where an 8(a) Annual Review Requirements List provided by the awardee was used to determine whether SBA should retain the small business joint venture partner as an 8(a) participant, but did not address whether a previously approved mentor-protégé agreement was currently in effect, and therefore the joint venture cannot avail itself of the exception to affiliation.
