Agency Reasonably Canceled Lease Solicitation Due to Environmental Concerns; COFC No. 15-370C, Open Spirit LLC v. The United States

Protest challenging the agency’s cancelation of a competition to lease a facility on a Navy base is denied, where the agency had reasonable concerns about the condition of the property, which were discovered and exacerbated during the procurement process, and where the protester’s allegations that the agency showed favoritism to the incumbent lessee were not supported by the evidence, and even if accurate, did not prejudice the protester, who was recommended as the awardee prior to the cancelation.
