Agency Ordered to Pay Protester’s Full Attorney Fees After Misleading Court; COFC No. 16-44C, Starry Associates v. United States and Intellizant LLC

Successful protester’s motion to recover attorney fees at the actual amounts billed is granted, where the Court of Federal Claims found the agency’s position was not substantially justified and the Equal Access to Justice Act’s special factors provision was applicable, where the agency knowingly misled the protester, the Government Accountability Office, and the court about its decision to cancel a solicitation and reissue a request for proposals that eliminated the requirements that the original awardee was unable to meet.
