Ninth Circuit Reverses Dismissal of FCA Case Based on Patent Fraud

Law360 – The Ninth Circuit has revived an FCA suit that claims a pharmaceutical company extended its monopoly on a drug through a fraudulently obtained patent, on the grounds that the patent proceedings and prior news coverage didn't indicate that the company committed fraud, and thus don't fall under the public disclosure bar.
