In a March 3 speech, DOJ Criminal Division chief Kenneth Polite announced that their Evaluation of Corporate Compliance Programs, which prosecutors use to make corporate charging decisions, will now consider the effectiveness of a company’s policies and procedures governing the use of personal devices and electronic communications platforms, including third-party messaging applications.
