Sixth Circuit Defines Kickbacks More Narrowly, Splitting from Third

In a new ruling, the Sixth Circuit has lined up with the Eighth Circuit by requiring False Claims Act cases to directly connect kickbacks with the health care billing in question, and rejecting an “anything-of-value” understanding of prohibited remuneration under the Anti-Kickback Statute.
