Neuro Injury Plan to Pay $51 Million for Ignoring Medicaid Payer of Last Resort Rule

The Florida Birth-Related Neurological Injury Compensation Plan and its administrator have agreed to pay $51 million to resolve allegations that they directed participants in the plan to submit claims directly to Medicaid rather than to them, in violation of Medicaid’s status as the payer of last resort under federal law.
