Ninth Circuit Reverses District Court’s You-Win-Some You-Lose-Some Theory of Materiality

A district court held that the defendant’s use of a billing code modifier that ensured automatic payment of certain claims was not material to the government’s payment decision, because an appeal process sometimes resulted in reimbursement of claims that did not use the modifier.
