Court of Federal Claims (COFC) Ruling May Shield Certain Contractors from Cost Accounting Standard (CAS) Violations

Aronson – In a recent decision, the COFC stated there's an “open question” as to whether the government has waived a claim for a contract adjustment based on an alleged cost accounting standards noncompliance when the government unduly delays evaluating the contractor’s disclosed practices, and enters into contracts based upon those disclosed practices in the interim. Presumably the COFC will answer this “open question” during the course of this litigation.
