Senate Commerce Republicans Introduce Comprehensive Privacy Bill
Senate Commerce Committee Chairman Roger Wicker (R-MS) and Senators John Thune (R-SD), Deb Fischer (R-NE), and Marsha Blackburn (R-TN) have introduced the Setting an American Framework to Ensure Data Access, Transparency, and Accountability (SAFE DATA) Act, an update of Wicker’s 2019 draft United States Consumer Data Privacy Act.
There are a few notable changes and additions, particularly language limiting the use of social media algorithms, added from Thune’s Filter Bubble Transparency Act and the Deceptive Experiences to Online Users Reduction (DETOUR) Act introduced by Fischer and Senator Mark Warner (D-VA). Other updates include changes to definitions such as “de-identified data,” “large data holder,” “sensitive data,” and “precise geolocation information.” Other provisions address a “right to opt out” of data collection, and equal access to services regardless of exercising privacy rights. The bill would appropriate $100 million to the FTC to implement these provisions.
