The Seventh Circuit Court of Appeals recently decided a case that created a new standard to assess requests by the Department of Justice to dismiss declined qui tam suits under the False Claims Act. Prior to this decision, federal Courts of Appeals applied either the Sequoia Orange standard or the Swift standard.
