Batter Up! DOJ Strikes Out on Avoiding Production of Escobar “Mine Run” Discovery

Just days after Major League Baseball announced the return to baseball earlier this month, a district judge in United States ex rel. Goodman v. Arriva Medical, et al. ordered the government to produce discovery regarding its treatment of other Medicare providers in the so-called “mine run” of cases under Escobar when materiality is a disputed element. All in all, we view this as a helpful decision for the defense bar.
