Latest SEC FCPA Complaint Vulnerable to Dismissal

Former SEC enforcement counsel Cory Kirchert and Adriaen Morse write about an FCPA case recently filed by the SEC which “raises more questions than it answers.” They note that press releases about such cases usually describe a company’s cooperation, in particular to mention self-disclosure or that the company’s cooperation contributed to a light penalty.
