Ostensible Subcontractor Rule Does Not Apply to a Mentor-Protégé Arrangement Between a Small and Large Business; SBA No. SIZ-6012, Size Appeal of Global Dynamics LLC

Appeal of SBA’s size determination is denied where (1) the events that allegedly negated the joint venture’s small business status occurred after the date to determine size, (2) the joint venture satisfied the SBA regulations in effect on the size determination date, and (3) the “ostensible subcontractor” did not apply to a joint venture composed of a mentor and protégé.
