From Theory to Practice: DOJ Asserts Its Rightful Authority

A recent False Claims Act case demonstrates that recent Granston memo–in which the Department of Justice asserted its right to ask the courts to dismiss meritless qui tam cases. In Maldonado v. Ball Homes, the relator alleged the defendants submitted falsified documents to obtain federally-backed loans. DOJ declined to intervene and moved to dismiss the case. In recent years, relators have become more likely to ignore the government’s decision not to intervene and instead will continue to pursue their cases. Maldonado is also noteworthy because the government does not usually file a motion to dismiss without first intervening.
