Contractor Disqualified from Receiving a Small Business Set Aside where it is Unusually Reliant On and Thus Affiliated with Proposed Subcontractors; COFC 17-1938, Ideogenics LLC v. United States

Protest of a decision by SBA’s Office of Hearings and Appeals, which determined that a contractor was reliant on subcontractors and thus not a qualified small business, is denied, where OHA did not: (1) misapply SBA precedent, (2) misapply an executive order, (3) fail to consider past performance information, (4) misinterpret the contractor’s teaming agreements, (5) wrongly assume that subcontractor involvement would impede the contractor’s control over performance, or (6) improperly exclude evidence on appeal.
