The Court of Appeals for the Federal Circuit sustained the government’s cross-appeal that the trial court did not have jurisdiction to hear a claim seeking a declaratory judgment that a partial termination for convenience was improper; the Court affirmed the trial court’s determination that the government properly terminated the remainder of the contract for default when the contractor failed to timely perform.
