Protester’s Proposal Exceeded Solicitation Requirements, but Not in a Meaningful Way; GAO B-413805.5, Enterprise Resource Planned Systems International LLC
Protest challenging the agency’s technical evaluation is denied, where the agency was not required to assign additional strengths to protester’s proposal on the basis that the protester designated virtually all of its personnel as “key”, because the agency did not consider this meaningfully beneficial; and protest alleging a number of organization conflicts of interest on the part of the awardee’s subcontractor is denied, where the agency reasonably investigated the allegations and found no hard facts or evidence supporting them; and protest arguing the agency should have found the awardee nonresponsible is denied, where the agency considered the facts of a qui tam lawsuit involving the awardee and found that the allegations against the awardee had been dismissed.
