Agency Not Required to Consider Length of Performance on Task Order Reference; GAO B-413546.4, Technica LLC

Protest challenging the agency’s evaluation of offerors’ past performance is denied, where the RFP did not require the agency to consider the length of time an offeror performed on a past performance reference and did reserve the right of the agency to consider performance that occurred after the closing date for proposals but prior to award; and where the agency did not treat offerors disparately by refusing to consider a reference from the protester’s teaming partner, because the work was still in the transition phase and the contractor had not taken full operational control of the work.
