Agency Reasonably Released Vendors’ Ratings and Pricing to Level Playing Field After Multiple Protests; GAO B-413703.8, Systems Plus Inc.
Protest challenging the agency’s corrective action, taken in response to an earlier GAO protest, is denied, where the agency reasonably concluded that the RFQ’s definition of recently performed contracts was contradictory or confusing, and the changes to the past performance criteria were within the agency’s discretion and intended to resolve an issue in the solicitation; and where the agency properly exercised its discretion to release all offerors’ ratings and prices before accepting final proposal revisions, to remove a competitive advantage gained by the previously unsuccessful offerors; and where the agency’s change to the past performance recency requirement allowed at least one offeror to continue with the competition, but was not intended to benefit any particular offeror.
