Protester Retains Right to Challenge Award After Debriefing, Even When Debriefing Was Not Timely Requested; GAO B-414579, Sancilio & Company Inc.

Request to dismiss protest as untimely is denied, where the agency voluntarily provided a debriefing to the protester, even though one was not timely requested, and therefore the protester could avail itself of the debriefing exception to a timely filing of its protest; and protest arguing the awardee’s proposal should have been rejected as technically unacceptable because it was not incompliance with the Trade Agreements Act is dismissed, where the protest is based on incorrect information about the awardee’s product and where the agency had no reason to doubt the awardee would comply with the Trade Agreements Act.
