Contractor Bears Burden for Underestimating Vacation Pay Accrued by Incumbent Employees; CBCA 5036, SecTek Inc. v. National Archives and Records Administration

Appeal of the contracting officer’s deemed denial of a claim seeking increased costs for employee benefits is denied, where the agency was prohibited by the FAR from providing an employee seniority list from the current contractor until after award, and where the contractor’s quotation stated that it was inclusive of all costs, including employee vacation time, and therefore the contractor was responsible for underestimating the amount of vacation time accrued by the incumbent employees.
