Contractor Cannot Prove Racial Discrimination Influenced Decision Not to Renew Contract; PSBCA No. 6606, William Finley v. United States Postal Service

The government’s motion to dismiss an appeal of its decision not to renew the appellant’s contract is denied, where the contractor filed a monetary claim for damages caused by the nonrenewal; and government’s motion for summary judgment is granted, where the government had the discretion to decide whether or not to renew the contract, where the appellant’s claims of bad faith and abuse of discretion are based on speculation, and thus do not create a genuine dispute as to a material fact, and where the appellant’s allegation the government showed favoritism to the successor contractor should have been raised in a procurement protest.
