Protest Dismissed as Academic Not Reinstated by Agency Inaction; GAO B-413382.3, HP Enterprise Services, LLC—Reconsideration

Request for reconsideration of prior decision, which dismissed a protest due to GAO’s lack of jurisdiction over civilian agency task order protests, is denied, notwithstanding Congress’s reinstatement of such jurisdiction, where the reinstatement of GAO’s jurisdiction was not made retroactive; and request to consider reconsideration request as a new protest is denied as untimely, because it was filed within 10 days of the reinstatement of GAO’s civilian agency task order protest jurisdiction, but not within ten days of when the protester knew, or should have known, of its basis for protest; and request to reinstate initial protest is denied where the protest was dismissed as academic and where subsequent agency inaction does not provide a basis to reinstate the protest.
