Agency’s Mention of Low Price During Discussions Did Not Mislead Protester Into Pricing Itself Out of Competition; COFC No. 16-1311C, Global Dynamics LLC v. United States

Protest challenging the agency’s decision not to award the protester one of several services contracts is denied, where the protester’s decision to raise its prices after discussions were the result of its own business judgment, and where, if the protester believed the agency improperly conducted a price realism analysis when the solicitation did not provide for one, it was required to raise that concern at the time of discussions.
