Protest challenging the agency’s technical evaluation is denied, where the solicitation required strict compliance with a maximum number of annual labor hours per employee, not compliance with local foreign labor laws; and protest challenging the agency’s past performance evaluation is denied, where the agency reasonably considered both positive and negative information about the protester’s previous performance, and where negative information regarding other offerors’ performance was not as substantial as similar information about the protester, and where the agency was not required to consider past performance information about the awardee’s sister company, when that company would not have any role in contract performance; and protest challenging the agency’s cost realism evaluation is denied, where the agency’s evaluation was thorough and where the agency was not required to consider offerors’ compliance with local labor laws as part of its cost evaluation.
