Maynard Nexsen – The Government Accountability Office released its much-anticipated Bid Protest Annual Report to Congress for Fiscal Year 2024, which was submitted to Congress on November 14. GAO’s annual report good insight into their bid protest function, including key statistics and GAO’s most prevalent grounds on which it sustained bid protests during FY24.
The GAO report and analysis by Joshua Duvall in Govconjudicata suggests that it is worth protesting if a losing offeror believes there was an unreasonable technical evaluation, flawed selection decision, or unreasonable cost and price evaluation, the top three reasons for sustained protests. There is a 52% chance that protestors will receive some sort of relief, such as voluntary corrective action by the department or agency or sustaining the protest.
